OVERVIEW

Welcome to PetsMeGo! The terms “we,” “us,” and “our” refer to PetsMeGo. PetsMeGo operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). PetsMeGo is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy, available at https://petsmego.com/policies/privacy-policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or territory of residence and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information.

You represent and warrant that all information you provide is accurate, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity occurring through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to provide accurate representations of our products and services. However, colors, dimensions, packaging, and product appearance may differ slightly from what appears on your screen because of device settings, manufacturing updates, or other factors.

We do not guarantee that a product’s appearance will be identical to the images displayed in our store.

Product descriptions, prices, availability, and specifications may change without notice. We reserve the right to discontinue a product at any time and may limit the quantities offered to any person, geographic region, or jurisdiction.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. PetsMeGo reserves the right to accept or decline an order for legitimate reasons, including product unavailability, suspected fraud, pricing errors, payment problems, or shipping restrictions.

An order is not accepted until PetsMeGo confirms acceptance and successfully processes payment.

Please review your order carefully before submitting it. PetsMeGo may be unable to accommodate cancellation or modification requests after an order has entered processing.

If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided with the order.

Purchases are subject to our Refund Policy, available at https://petsmego.com/policies/refund-policy.

You represent that purchases are intended for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 – PRICES AND BILLING

Unless otherwise stated, prices displayed in our store are in U.S. dollars.

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is placed and will be included in the order confirmation.

Unless otherwise stated, displayed product prices do not include applicable taxes or shipping charges. Any applicable taxes and shipping charges will be displayed during checkout before payment.

Orders under $50 are charged a flat standard shipping fee of $6.99. Orders of $50 or more qualify for free standard shipping within the United States.

Promotions may be governed by separate terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms will apply to that promotion.

You agree to provide accurate and complete purchase, payment, and account information and to update your information when necessary.

You represent that you are authorized to use the payment method submitted and agree to pay all charges associated with your order, including applicable shipping charges and taxes.

SECTION 5 – SHIPPING AND DELIVERY

Orders are processed and delivered according to our Shipping Policy, available at https://petsmego.com/policies/shipping-policy.

PetsMeGo currently ships to addresses within the United States.

Orders are generally processed within 1–2 business days. Standard delivery generally takes an additional 5–8 business days after processing.

Delivery times are estimates and are not guaranteed. Delays may occur because of carriers, severe weather, holidays, address errors, high order volumes, product availability, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. If you notice an error after placing an order, contact us immediately at support@petsmego.com. We cannot guarantee that an address can be changed after processing begins.

If an order is significantly delayed, lost, or damaged during delivery, please contact us at support@petsmego.com.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including our trademarks, brands, text, displays, images, graphics, product reviews, videos, audio, and the design, selection, and arrangement thereof, are owned by PetsMeGo, its affiliates, or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only.

Without our prior written consent, you must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services, except as permitted by applicable law.

Nothing in these Terms grants you a license or other rights under any patent, trademark, copyright, or other intellectual property belonging to PetsMeGo, Shopify, or another party.

PetsMeGo’s names, logos, product and service names, designs, and slogans are trademarks or trade identifiers of PetsMeGo or its licensors. Shopify’s names, logos, product and service names, designs, and slogans belong to Shopify. Other names, logos, and brands belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services. We do not necessarily monitor or control these tools.

Access to third-party tools is provided “as is” and “as available,” without warranties, representations, conditions, or endorsements to the fullest extent permitted by law.

Use of optional third-party tools is at your discretion. You should review and understand the applicable third-party terms before using them.

New features, tools, and resources that we may offer through the Services will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain materials, functionality, or links provided or operated by third parties.

We are not responsible for examining or evaluating the content, accuracy, practices, or policies of third-party websites you choose to access.

If you leave our Services to access a third-party website, you do so at your discretion. Please review the third party’s policies and practices before entering into a transaction or providing personal information.

Nothing in this section limits any responsibility PetsMeGo has to customers under applicable consumer protection laws or our published policies.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

PetsMeGo is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and PetsMeGo.

Shopify is not the seller of the products offered by PetsMeGo and is not responsible for the fulfillment of transactions between you and PetsMeGo.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from transactions between you and PetsMeGo.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is handled according to our Privacy Policy, available at https://petsmego.com/policies/privacy-policy.

Certain personal information may also be processed according to Shopify’s Privacy Policy, available at https://www.shopify.com/legal/privacy/app-users.

Because the Services are hosted by Shopify, Shopify processes certain information relating to your access to and use of the Services. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside your country of residence, as described in our Privacy Policy.

SECTION 11 – FEEDBACK

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, photographs, videos, or other content relating to PetsMeGo or the Services (“Feedback”), you grant PetsMeGo a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for operating, improving, and promoting the Services.

You represent that you own or have the rights necessary to submit the Feedback, that you have disclosed any compensation or incentives connected with it, and that the Feedback does not violate these Terms or the rights of another party.

We are not obligated to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback.

We may monitor, edit, or remove Feedback that we reasonably determine is unlawful, misleading, abusive, obscene, defamatory, fraudulent, or otherwise objectionable, or that violates intellectual property, privacy, or other legal rights.

You may not use a false email address, impersonate another person, or mislead us or other users regarding the origin of Feedback.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

Information presented through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability.

We reserve the right to correct errors, update information, or cancel an affected order when information is materially inaccurate, including after an order has been submitted.

If an order is cancelled after payment because of an error or product unavailability, the applicable payment will be refunded.

SECTION 13 – PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services directly or indirectly:

(a) for unlawful, fraudulent, or malicious purposes;

(b) to violate international, federal, provincial, territorial, state, or local laws;

(c) to infringe our intellectual property rights or the rights of another party;

(d) to harass, abuse, threaten, defame, intimidate, or harm another person;

(e) to transmit false, fraudulent, or misleading information;

(f) to upload or transmit content that violates these Terms;

(g) to transmit unsolicited advertising, spam, chain letters, or similar solicitations;

(h) to impersonate another person or entity; or

(i) to engage in conduct that interferes with another person’s use of the Services or exposes PetsMeGo, Shopify, our customers, or another party to harm or liability.

You also agree not to:

(a) upload or transmit viruses, malware, or malicious code;

(b) reproduce, duplicate, copy, extract, sell, resell, or exploit the Services without authorization;

(c) unlawfully collect or track personal information;

(d) engage in phishing, pharming, pretexting, scraping, or similar abusive activity;

(e) use robots, spiders, automated extraction tools, artificial intelligence tools, or other automated processes to access the Services except as expressly permitted under Section 14 or authorized by us; or

(f) interfere with, bypass, or circumvent security, authorization, access-control, or robot-exclusion measures.

We reserve the right to suspend, disable, or terminate access to the Services if we reasonably determine that these Terms have been violated.

SECTION 14 – AUTOMATED AGENTS

This section applies if you deploy or permit software that takes autonomous or semi-autonomous actions on behalf of a person or entity to access or interact with the Services (an “Agent”).

An Agent must not access or interact with the Services if we have requested that the Agent stop doing so.

We may use technical measures to control whether and how Agents access or interact with the Services.

Agents must:

(a) identify themselves accurately in applicable HTTP or HTTPS requests;

(b) not conceal or misrepresent their automated nature;

(c) not impersonate human behaviour for the purpose of bypassing restrictions;

(d) not complete or circumvent CAPTCHAs or similar security measures;

(e) respond truthfully when asked whether an interaction is automated; and

(f) comply with measures designed to regulate automated access.

Nothing in this section prohibits ordinary search engine indexing that complies with our published technical instructions.

SECTION 15 – TERMINATION

We may suspend or terminate access to the Services when reasonably necessary, including for a violation of these Terms, suspected fraud, unlawful activity, security concerns, or misuse of the Services.

You remain responsible for amounts properly due before termination.

Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, feedback, disclaimers, limitation of liability, indemnification, severability, assignment, governing law, and privacy.

SECTION 16 – DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes. We do not guarantee that all information will always be complete, current, or error-free.

Except for warranties, guarantees, and rights that cannot legally be excluded, the Services and products offered through the Services are provided “as is” and “as available,” without additional express or implied warranties.

We do not guarantee that access to the Services will always be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions in this section apply only to the extent permitted by law.

Nothing in these Terms excludes or limits mandatory consumer rights or product guarantees that apply under applicable law.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, PetsMeGo and its partners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the use of the Services or products purchased through the Services.

This limitation may include loss of profits, revenue, savings, data, or replacement costs, whether a claim is based in contract, tort, negligence, strict liability, or another legal theory.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including any mandatory consumer protection rights.

SECTION 18 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless PetsMeGo, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, or reasonable legal expenses arising from:

(a) your material breach of these Terms;

(b) your violation of applicable law or another party’s rights; or

(c) your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim. You agree to cooperate with the defence of such a claim.

We will not settle a claim in a manner that imposes non-monetary obligations on you without your reasonable consent.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies and operating rules posted through the Services, constitute the entire agreement between you and PetsMeGo regarding use of the Services and supersede prior or contemporaneous communications and proposals concerning the same subject matter.

Any ambiguity in these Terms will be interpreted according to applicable law and will not automatically be construed against either party.

SECTION 21 – ASSIGNMENT

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent.

We may transfer or assign our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the business, subject to applicable law.

SECTION 22 – GOVERNING LAW

These Terms and any separate agreements through which we provide the Services are governed by the laws of the Province of Nova Scotia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to mandatory consumer protection rights that may apply in the customer’s jurisdiction, you and PetsMeGo consent to the jurisdiction of the courts located in Nova Scotia, Canada.

Headings are provided for convenience only and do not limit or otherwise affect the meaning of these Terms.

SECTION 24 – CHANGES TO THESE TERMS

You may review the current version of these Terms at any time on this page.

We reserve the right to update, change, or replace portions of these Terms by posting an updated version on our website.

When required by applicable law, we will provide notice of material changes. Changes will take effect on the date stated in the notice or, if no date is stated, when the updated Terms are posted.

Continued use of the Services after changes take effect constitutes acceptance of the updated Terms to the extent permitted by law.
